These Terms of Service ("Terms") govern your access to and use of the yabby website builder platform at yabby.page and any related services (collectively, the "Service"), operated by Andreas Keller, Einzelfirma, Dorfhalde 36, 3612 Steffisburg, Switzerland ("we", "us", "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials, including any two-factor authentication setup
  • Promptly update your information if it changes
  • Accept responsibility for all activity under your account

You may sign up using email and password or via Google OAuth. You must be at least 16 years old to create an account.

The Service

yabby is a website builder for YouTube creators. The Service allows you to:

  • Create websites that showcase YouTube channel content
  • Import and sync videos, playlists, and channel metadata via the YouTube Data API
  • Customize website appearance with themes, colors, logos, and navigation
  • Publish websites on yabby.page subdomains or custom domains
  • Manage team access through organizations

YouTube Data API

The Service uses the YouTube Data API to import publicly available channel and video data. By connecting a YouTube channel, you acknowledge that:

We do not access your private YouTube data. We only retrieve publicly available metadata such as video titles, descriptions, thumbnails, view counts, and playlists.

Plans and Billing

Free and Paid Plans

The Service offers a free plan with limited features and paid subscription plans with additional capabilities. Plan details, pricing, and feature limits are described on our website.

Payment

Paid subscriptions are billed in advance on a recurring basis (yearly) via Stripe. By subscribing to a paid plan, you authorize us to charge your chosen payment method for all applicable fees.

All prices are in US dollars unless otherwise stated.

Cancellation and Refunds

You may cancel your subscription at any time from your dashboard. Upon cancellation:

  • Your subscription remains active until the end of the current billing period
  • You will not be charged for subsequent periods
  • No partial refunds are provided for unused time within a billing period

We may offer refunds at our discretion on a case-by-case basis.

Plan Changes

We reserve the right to modify plan pricing and features. Changes to pricing will take effect at the start of your next billing period. We will notify you of material changes in advance.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Infringe on the intellectual property rights of others
  • Upload or transmit harmful, threatening, abusive, defamatory, or offensive content
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or other users' access
  • Use automated systems (bots, scrapers) to access the Service without our written permission
  • Circumvent any usage limits, rate limits, or access controls
  • Resell or redistribute the Service without our written permission
  • Use the Service to build websites that promote illegal activity, hate speech, or violence

We may suspend or terminate accounts that violate these rules at our discretion.

Intellectual Property

Our Content

The Service, including its design, code, features, and documentation, is owned by us and protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

Your Content

You retain ownership of all content you create or upload through the Service, including website configurations, text, and media you provide. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute your content solely for the purpose of providing the Service.

YouTube video data imported through the Service remains subject to YouTube's terms and the respective content creators' rights.

Published Websites

Websites you publish through the Service are publicly accessible. You are solely responsible for ensuring that the content of your published websites complies with applicable laws and does not infringe third-party rights.

Organizations and Teams

The Service supports multi-user access through organizations. Organization owners and admins can:

  • Invite members by email
  • Assign roles (owner, admin, member)
  • Manage organization settings, billing, and websites

Organization owners are responsible for the actions of their team members within the Service.

Availability and Support

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or changes that temporarily affect availability.

Support is provided via email on a reasonable-efforts basis.

Account Suspension and Termination

By You

You may delete your account at any time from your dashboard. Upon deletion, your data will be removed in accordance with our Privacy Policy.

By Us

We may suspend or terminate your access to the Service immediately, with or without notice, if:

  • You breach these Terms
  • Your use poses a security risk to the Service or other users
  • We are required to do so by law
  • We discontinue the Service

Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account and associated data after a reasonable retention period
  • Provisions that should survive termination (intellectual property, limitation of liability, governing law) remain in effect

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Results obtained from the Service will be accurate or reliable
  • Defects will be corrected

Limitation of Liability

To the maximum extent permitted by Swiss law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:

  • Content you publish through the Service

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

If you do not agree to the modified Terms, you must stop using the Service and delete your account.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Canton of Bern, Switzerland.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
